Possible copyvio - I'm not completely confident about this nomination, but there are several worrying indications with this file.

  • Kyoto University published the same photo, but in larger resolution. [1] Kyoto University published a very similary photo, in a larger resolution. Attributed to Center for iPS cell Research and Application, Kyoto University.
    • Corrected per comment below by Was a bee. It was similar but not identical. I was unaware of the minor differences between the two photos. --whym (talk) 12:00, 9 October 2012 (UTC)[reply]
  • Times Union published the same photo, but in a larger resolution. [2] It was published later than the one on Commons, though. No description about the photo was given in the article.

However, I also note that this file is the earliest one uploaded on the web as far as I could find. Particularly, it was uploaded prior to the Kyoto University one (at least the Flickr and EXIF information says so).

Pictogram voting info.svg Info Quick response from was_a_bee who transferred the image from Flickr using FlickrUploadBot 2 and a half years ago. On my memory, original uploader of this photo looked to me, as a professional photographer, who took this photo by himself. The exact reason of why I thought so at that time is obscure at this time. Perhaps because of he uploaded other camera-angle-shot or because of his name was credited at other website on similar but little bit different photo. It's obscure. As a possibility, perhaps I may also have made a miss something. So contacting him is one of nice option.   • Given evidences of mixed natures, I thought I would ask the relevant parties for clarification, and I sent inquiries to CiRA at Kyoto University and Flickr user Rubenstein to clarify copyright status of the file in concern.   • Note: The photo linked by Polarlys above from the NYTimes is the same photo as on the CiRA website, however this photo is not the same photo as on commons. The NYTimes/CiRA photo is taken from a position slightly further to the right of the commons photo and differences in the position of elements in the background makes this clear. While very similar, this is not evidence of a copyvio, just that the two photographs were taken in proximity of each other at the same time and location. This is fairly standard for press release photography where photographers are generally lined up at a moderate distance to take their shots.     • Pictogram voting comment.svg Comment - In reply to NULL's comment above, the photos appears to be among a series of photos by a single photographer, serially taken within a very short period. If they were taken by different photographers by different cameras, the focus and EXIF information should not be identical. And just to make sure, I already got a reply from CiRA and it was CC'ed to OTRS and verified by Miya as you can see above.   • Pictogram voting info.svg Info Thank you for contacting for confirmation and clarification. At this time, for the sake of discussions in Commons, I recall and clarify my memories of situations when I transfered this image from Flickr 2 and a half years ago. Currently the Flickr account[6] shows only 24 images (some buildings and some sweets.). But 2 and half years ago, when I checked, there are many more photographs including many portrait photographs. This is certain. Although all of its are already unvisible on Flickr, but some of its collections are uploaded to Commons (the number of photos have transfered from this Flickr account, seems to be approximately over 250[7][8]). As far as I remember, professional photographer's real-name (I don't remember the name, but I think that was not Japanese name) was credited under the picture when I checked the page (just like this page[9], currently visible only via direct link). So at that time, I googled the photographer's name, and I confirmed that is real photographer's name (I maybe found personal homepage or so. What name and What type of page are obscure, but it is certain that I did this type of checking search). And I could not find copyvio-images in that Flickr collection (I did not check all images. Only part of it). Additinally, as far as I remember, that name was credited in other website, academic prize website or university website, something official-like website (this situation is obscure to me, but I feel this is something true). This is outline of the situation why I judged this image is taken and uploaded by professional photographer.
    P.S. Pastly I thought "Rubenstein" is Internet handle of the photographer, but now, I wonder if it is company name of "Rubenstein Communications"[10]. I don't know background though.--Was a bee (talk) 10:24, 10 October 2012 (UTC)[reply]

Pictogram voting comment.svg Comment I have thought about this issue in some days. Simply just deleting this image is, i feel, valid. So I support deletion. But, At the same time, hundreds of images have been transferred to Commons from this Flickr account. So I would write here a bit details what I searched and am guessing about this image and Flickr account. On my thought

  1. Flickr account rubenstein_ may be maintained by media company "Rubenstein Communications"[11], founded by en:Howard J. Rubenstein, located at New York, US (or maintained personally by a professional photographer who belongs Rubenstein Communications).
  2. Main maintainer of this Flickr account (or owner of this Flickr account) may be, I suppose, this person([12]), because of many search resluts hit on commons for this person's name([13]).
  3. And, I guessing that, Rubenstein Communications (or the person) may uses this Flickr page for distributing photos to other journalists (sending an e-mail which include linked-URL to Flickr page, instead of sending an e-mail in which heavy photo embedded)
  4. Some pages of this flickr photo collection, at least certainly this page[14], uses CC-BY tags wrongly. This may happened because misinterpretation of meaning of CC-Attribution or simply a mistake of page-setting.

Time line of File:Shinya_Yamanaka2.jpg image would be as follows.

  1. Yamanaka's photo was taken by Kyoto University CiRA at April 2009[15].
  2. Yamanaka won the Lasker award September 2009[16][17].
  3. Rubenstein Communications did a role as a proxy of media relations of Lasker foundation.([18]).
  4. Rubenstein Communications (or its staff) may got photo from Kyoto University CiRA.
  5. Rubenstein Communications (or its staff) maybe distributed its photos to other jounalists through this Flickr page[19]. This page had been wrongly tagged as cc-by.
  6. A journalist or writer who got this photo through Rubenstein, credited this photo as something like "courtesy of Rubenstein" or so. (I saw something like that. This is one reason why I misjudged the copyright status of this image.)
  7. I transferred this image from Flickr to Commons using FlickrUploadBot at May 2010[20].
  8. Kyoto University CiRA uploaded very high resolution version of the photo to their website at December 2010. (Date information is based on EXIF of the file[21])
  9. Yamanaka won Nobel prize October 2012.
  10. Yamanaka's article got attentions[22].
  11. Potential infringement was noticed by User:Akaniji and deletion request was proposed by User:Whym.
  12. Confirmation e-mails ware sent to Kyoto University and Flickr account by Whym.
  13. Response from Kyoto University CiRA says this photo is CiRA's photo and requesting deletion of photo from Commons. Checked by Whym and Miya.
  14. As of now, there are no response from Flickr account.
